Terms & Conditions

These terms govern access to and use of faujihome.com (the “Platform”), owned and operated by WEBZOTICA BUSINESS FAMOUS SOFTWARE PRIVATE LIMITED (CIN: U63112HR2023PTC116103).

1. Introduction

The Platform includes our website, subdomains, mobile/web applications, and APIs. We may update these Terms by posting a revised version; continued use constitutes acceptance. We may suspend services for maintenance or upgrades.

2. Definitions

  • Subscriber/User: Anyone who accesses or uses the Platform. Certain areas may require an account.
  • Browser/Visitor: Person using public sections without logging in.
  • Advertiser: User posting listings, banners or promotional material.
  • Services: Information services, search tools, listing/advertising space and CRM/marketing tools. We act only as an information intermediary.
  • RERA/RERDA: Real Estate (Regulation and Development) Act, 2016 and applicable rules.

3. Submission & administration of listings/advertisements

By submitting property data, photos, videos or contact details, you confirm you have all necessary rights to publish the material on the Platform. If applicable, you shall comply with RERA/RERDA and disclose all material facts about the property, including title/ownership/encumbrances and dimensions. We may request supporting documents and can edit, reformat, refuse or remove any listing at our discretion. You grant faujihome.com a worldwide, royalty-free, transferable licence to host, use, reproduce, adapt, distribute and promote the content for Platform operations and marketing. Users must independently verify all aspects of a property; any “verified” badge (if shown) does not certify documents, title, area or pricing.

4. Content moderation using technology & human review

We use proprietary and third-party moderation technologies (including AI-assisted tools) and human reviewers to detect harmful or policy-violating content. Moderation outcomes may approve, reject or escalate items. Decisions can be appealed via our grievance channels; we strive for fairness but the service is provided “as is”.

5. Payment terms & refunds

Paid Services are typically 100% in advance. Fees are non-refundable unless expressly stated by WEBZOTICA BUSINESS FAMOUS SOFTWARE PRIVATE LIMITED. We use third-party payment gateways and do not store card data. Refund timelines depend on banks/gateways. For failed transactions we reconcile promptly but settlement times aren’t guaranteed.

6. CPL marketing campaigns with developers & brokers

For CPL campaigns, we endeavour to deliver the agreed number of leads at the agreed CPL, using channels chosen at our discretion. We may pause/stop campaigns upon delivery completion or non-payment. We neither guarantee conversions nor participate in downstream transactions. Duplicate-lead and data-protection obligations apply.

7. Video community guidelines & screening

Videos must be original and free of copyright issues; do not upload PII, obscene/inappropriate material, or hateful content. Videos may go through technology + human screening and may be removed at our sole discretion. We may use third-party hosting/streaming services and you agree to their applicable terms.

8. Use of information

Treat member-only information as confidential and use it only for legitimate personal/internal evaluation. Do not re-publish, scrape, mass-download, or create derivative databases from Platform content.

9. Intellectual property rights

All trademarks, logos and service marks displayed on the Platform are the property of their respective owners; use is prohibited without prior written consent. We grant a limited, revocable, non-exclusive, non-transferable licence to access and use the Services in accordance with these Terms.

10. Restrictions / Prohibited conduct

Do not: copy/extract/scrape data; use spiders/robots; attempt unauthorized access; breach security; reverse engineer; bypass technical protections; overload infrastructure; spam; impersonate others; host illegal, harmful, infringing or misleading content; or use the Platform to compete or provide substitute services. Violations may result in immediate suspension and legal action.

12. Disclaimer of warranties

The Platform and its content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, non-infringement, accuracy, or uptime). Users must conduct due diligence before any transaction.

13. Limitation of liability

To the maximum extent permitted by law, WEBZOTICA BUSINESS FAMOUS SOFTWARE PRIVATE LIMITED and its affiliates shall not be liable for any indirect, incidental, special, punitive, exemplary or consequential damages, or loss of profits, data, goodwill or business, arising from or related to the Platform.

14. Termination / suspension

We may suspend or terminate accounts or access at any time, with or without notice, for violation of these Terms, legal requirements, or risk/harm to the Platform or users.

15. Indemnification

You agree to defend, indemnify and hold harmless WEBZOTICA BUSINESS FAMOUS SOFTWARE PRIVATE LIMITED and its officers, employees and agents from any claims, losses, damages, liabilities, costs and expenses (including legal fees) arising out of your content, your use of the Platform, or your breach of these Terms or applicable law.

16. Privacy

Our Privacy Policy explains how we collect, use and share personal data and the controls available to you. By using the Platform, you consent to processing in accordance with that policy.

17. Terms of use for Users

By expressing interest in listings or services, you authorize us to share your details with relevant advertisers/service providers who may contact you via phone/SMS/WhatsApp/email. We are not responsible for third-party forms, messages or processes. Public content may be accessed worldwide; avoid posting sensitive information and use available privacy controls.

18. Terms for dealers / builders / banks / payment gateways

You must comply with applicable data-protection laws; implement adequate security; process only necessary personal data; honour data-subject rights; and avoid sharing data with sub-processors without adequate safeguards.

19. Arbitration

Disputes shall be referred to a sole, independent arbitrator. Seat/place of arbitration: Delhi, India. Proceedings governed by the Arbitration & Conciliation Act, 1996. The arbitrator’s decision will be final and binding.

20. Miscellaneous

Governing Law & Jurisdiction: Laws of India; exclusive jurisdiction of courts at New Delhi, India.
Severability: If any provision is held invalid, the remaining provisions remain in effect.
No Waiver: Failure to enforce a provision is not a waiver of the right to do so later.
